Terms and Conditions

Definitions: In these terms and conditions Run Up Runners or Run Up means the running club associated with Run Up Lancaster. Run Up Run Leader(s) means any individual considered a volunteer organiser of Run Up events. Participant or runner means any individual who attends a Run Up event or run. Members of Public means any individual not attending a Run Up event.

1. Age: Participants(s) must be age 18 and over can participate in Run Up runs and events.

2. Health and Safety: Participant(s) take full responsibility for any injury or health condition sustained whilst partaking in our events. Participant(s) also take full responsibility for any injury or health condition sustained whilst partaking in Run Up events arising from a previous medical condition. 

3. Run Up Leader(s) are not medically trained and are therefore not qualified to assess if the runner(s) is in appropriate physical condition to attend our events. By agreeing to these Terms and Conditions you declare that you are in good health, physically fit and are not aware of any physical or psychological reasons why you cannot take part in any event that is hosted by Run Up.

4. Risk and Health and Safety: A risk assessment for all running events has been conducted and the risks are deemed to be sufficiently low for the events to proceed. Run Up takes no responsibility for participant(s) actions during one of our events and provides no liability cover for those participating. All participant(s) take part in our events at their own risk. 

5. Our Conduct code: Run Up promotes a safe and social community of runner(s) and Run Up Run Leader(s). Runner(s) and Run Up Run Leader(s) are expected to support each other at all times, enabling a welcoming and respectful environment that is free from harassment, discrimination and intimidation during runs. Run Up does not tolerate any form of harassment, bullying or abusive behaviour aimed at Run Up Run Leader(s), runner(s) or members of the public from participant(s) or Run Up Run Leader(s). Please behave safely and do not harm others or put them at risk at any Run Up events or runs. Runner(s) are encouraged to voice any concerns to fellow Run Up Run Leaders(s) if they experience any harassment, bullying or abusive behaviour. Please respect and acknowledge members of the public on Run Up events and runs. ‍

6. Photography, Video and third-party vendors: On Run Up runs and events, photos and videos may be taken for use by Run Up Run Leader(s), Run Up and affiliates, sponsors and third-party vendors marketing tools. By attending our events, you agree that these can be used by Run Up and its affiliates, sponsors and third-party vendors.

7. Personal Property: Run Up runs and events take place on public roads and footpaths. (Unless informed) We do not offer a bag drop or accept liability for any loss, theft or damage of runner(s) property during a Run Up run or event.

8. Limitation of Liability: Nothing in these terms and conditions shall limited or exclude Run Up of liability for (1) death of personal injury caused by negligence or negligence of its personnel or agents (2) fraud or fraudulent misrepresentation (3) any other liability which cannot be limited or excluded by applicable law. Consequential loss arising under, or in connection with, these terms and conditions and (b) Run Up and its affiliates, sponsors and third party vendors total liability to the member or participant(s) whether in contract, breach of statutory duty or otherwise arising under or in connection with these T&Cs shall be limited to £50.

9. Savings (servability) clause: If any provision of this contract is held unenforceable, then such provision, if allowable, will be modified to reflect the parties' intention. All remaining provisions of these terms shall remain in full force and effect.

10. If participant(s) do not agree to the terms and conditions to the event, they will not be allowed to partake in the event. Participation is at Run Up discretion and availability may be restricted. All participant(s) agree to abide by these terms and conditions and failure to do so may result in being removed from the event or from the community entirely.

Changes to Run Up T&Cs: Run Up may amend these T&Cs. Any changes will be affected immediately. 

Governing law and jurisdiction: these T&Cs and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-agreement disputes or claims) shall be governed by and constructed in accordance with the law of England and Wales.
